1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Factictionary ("we", "us", or "our"), governing your access to and use of the Chalkly mobile application and related services (collectively, the "App" or "Service").

By downloading, installing, accessing, or using Chalkly, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately uninstall and discontinue using the App.

2. User Eligibility & Account Responsibility

  • Age Eligibility: You must be at least 13 years of age to use this App. If you are a minor under the age of majority in your jurisdiction, you must have the consent and supervision of a parent or legal guardian.
  • Account Security: You are responsible for safeguarding your login credentials and for all activities conducted through your account. You agree to notify us immediately at facticitonary@gmail.com of any unauthorized access or security breach.
  • Accuracy of Data: You agree to provide accurate and updated information when creating tutor profiles, student batches, and fee registers.

3. Permitted Use & Prohibited Conduct

Chalkly is licensed for personal educational, tutoring, and classroom administrative purposes. You agree NOT to:

  • Reverse-engineer, decompile, disassemble, or attempt to extract the source code or proprietary algorithms of the App.
  • Use the App for any illegal, fraudulent, or defamatory purpose.
  • Impersonate any person, tutor, institution, or entity.
  • Scrape, harvest, or systematically download the formula database, concept flowcharts, or user records without prior written consent.
  • Transmit malicious code, viruses, worms, or disruptive automated scripts.
  • Spam or harass students, parents, or other tutors through multi-channel sharing intents.

4. Educational Disclaimer & Curriculum Independence

  • Study Aid Reference: Chalkly provides curated formula flashcards, concept maps, and educational tips aligned with the CBSE/NCERT curriculum for Classes 9, 10, 11, and 12. These resources are intended as complementary study tools.
  • No Outcome Guarantee: While we strive for rigorous mathematical and scientific accuracy, Chalkly makes no warranties regarding examination results, competitive rankings, or academic performance.
  • Independence: Chalkly and Factictionary are independent software developers and are not affiliated with, endorsed by, or sponsored by the Central Board of Secondary Education (CBSE) or NCERT.

5. Subscriptions, In-App Purchases & Billing

  • Free & Premium Tiers: Chalkly offers a free tier supported by non-intrusive ads, as well as optional Premium subscriptions that unlock unlimited batches, advanced reporting, and ad-free usage.
  • Google Play Billing: All in-app purchases and subscription renewals are processed securely through Google Play In-App Billing in accordance with Google Play's Terms of Service.
  • Cancellations & Refunds: Subscriptions renew automatically unless cancelled at least 24 hours prior to the billing cycle through your Google Play Store account settings. All refund requests are subject to Google Play's standard refund policies.

6. Intellectual Property Rights

  • Chalkly Property: The App, its distinctive chalkboard visual design, UI layouts, software source code, custom diagram rendering engines, and brand assets are the exclusive intellectual property of Factictionary and protected under copyright, trademark, and trade secret laws.
  • User Content Ownership: Tutors retain full ownership of all student rosters, attendance records, fee logs, and test scores entered into Chalkly. You grant Chalkly a limited license to process and sync this data solely to provide the Service to you.

7. Advertisements

Free-tier editions of Chalkly may display advertisements delivered through Google AdMob. We make every effort to ensure all ads are family-safe and compliant with educational standards. We are not responsible for the content, privacy practices, or products offered by third-party advertisers.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHALKLY IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF DEFECTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, IN NO EVENT SHALL FACTICTIONARY, ITS DEVELOPERS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, REVENUE, OR GOODWILL) ARISING OUT OF OR CONNECTED WITH YOUR ACCESS TO OR INABILITY TO USE THE APP.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, without prior notice, if you breach these Terms or engage in activities that threaten the security or integrity of the Service. You may terminate your use at any time by deleting the App and requesting account removal by emailing facticitonary@gmail.com.

11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any legal action or dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the competent courts located in India.
